Terms of Service
Effective September 27, 2026.
These Terms of Service (“Terms”) govern your use of 1889advertising.online and any advertising subscription or service you purchase from 1889 Advertising (“we,” “us”), of Springfield, Missouri. By subscribing or using our services, you agree to these Terms. If you do not agree, do not subscribe.
1. Services
We provide advertising placement and related production services as described for the package you select on our Packages page (the “Services”). Each package describes the placements we will provide each month. We decide the timing, format, and creative execution of placements within the scope of your package, and we will work with you on messaging.
2. Eligibility and Accounts
You must be at least 18 and authorized to bind your business. The Springfield Local package is available to businesses based in or serving the Springfield, Missouri area; we may ask for information to confirm this and may move or decline a subscription that does not qualify. Your client portal is accessed with the email address used at checkout. You are responsible for keeping that email account secure.
3. Subscription, Billing, and Auto-Renewal
Packages are monthly subscriptions that renew automatically. When you subscribe, you authorize us, through Stripe, to charge the price shown for your package (in US dollars, plus any applicable taxes) now and on the same date each month until you cancel. Prices may change; we will give at least 30 days’ notice of a price change by email, and you may cancel before it takes effect. If a payment fails, we may retry it and may pause or end your placements until payment is resolved.
4. Cancellation
You may cancel at any time online, through the billing page linked on our Pricing page, in your welcome email and in your client portal (run by our payment processor, Stripe), or by emailing [email protected] from the address you subscribed with. Cancellation takes effect at the end of your current paid billing period; you keep the Services through that period and will not be charged again. Placements already scheduled for the current period will still run.
5. Refunds
Because placements are scheduled and produced for you when you subscribe, fees are non-refundable except where the law requires otherwise or where we fail to deliver the Services described for your package. If you believe we have not delivered, email us within 30 days of the charge and we will review it in good faith.
6. What You Provide
You will give us accurate information, links, and creative materials, and you promise that you own or have the right to use everything you give us, that your business, products, and claims are lawful and truthful, and that your advertising complies with our Advertising Policy and applicable law (including advertising, endorsement, and consumer-protection rules). You are responsible for the content of your offers and the destination pages we link to.
7. Our Right to Decline or Remove Content
We may decline, edit, pause, or remove any placement that we reasonably believe violates these Terms, the Advertising Policy, the rules of a platform we use, or the law. Advertising platforms set their own rules and may remove or restrict content at any time; we are not responsible for a platform’s decisions, but we will tell you if it affects your placements and work with you on a replacement.
8. Measurement and Reporting
Your client portal shows results measured by our own tracking of links and placements we control. Figures may differ from those reported by third-party platforms or analytics tools because of differences in method, ad blockers, privacy settings, bot filtering, and timing. We do not guarantee that any particular number of clicks, impressions, visitors, leads, or sales will result from the Services. See the Disclaimer.
9. Intellectual Property
You keep ownership of your brand, logos, and materials, and you grant us a limited license to use them to perform the Services, including displaying them in placements and, unless you ask us not to, describing you as a client. We keep ownership of our tracking systems, portal, reports, and our own content and templates. Creative we produce specifically for you is licensed to you for use in your own marketing once fees for it are paid.
10. Confidentiality and Privacy
We will protect non-public business information you share with us and use it only to provide the Services. Our handling of personal information is described in our Privacy Policy.
11. Disclaimers
The Services and this website are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services or portal will be uninterrupted or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, 1889 Advertising is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities, arising from the Services. Our total liability for any claim relating to the Services will not exceed the fees you paid us in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to defend and hold us harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your products or services, or your violation of these Terms or the law.
14. Suspension and Termination
We may suspend or end your Services immediately if you breach these Terms, if a payment is unresolved, or if we reasonably believe your advertising is unlawful or harmful. Sections that by their nature should survive termination will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. You and we agree that any dispute will be brought in the state or federal courts located in Greene County, Missouri, and you consent to that jurisdiction. Before filing a claim, each party agrees to try in good faith to resolve the dispute informally by contacting the other.
16. Changes to These Terms
We may update these Terms. The current version is always posted here with its effective date. Material changes will be emailed to active subscribers at least 30 days before they apply to you; continuing to use the Services after that date means you accept them.
